 These Terms will apply to any and all contracts between you and us for the sale of our products (Contract).

TERMS OF SALE AND RIGHT TO VARY SUCH TERMS

These Terms replace all previous agreements and understandings between us. We improveand modify these Terms from time to time. Every time you order products from us, the Terms in force and release in this page at the time of we receive your order will apply to the Contract between us.

 PLACING AN ORDER

Our website will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each stage of the order procedure. When placing an order you undertake that you are at least 18 years old, that all information you gave us are true and correct, that you are authorised to use the credit or debit card utilized to place the order and that there are enough funds to cover the cost of the product(s). We will send you an additional email to confirm that your product(s) have been dispatched. The Contract between us will be formed at the moment you receive the confirmation of your order. Only products shipped will be included in the Contact. Payment will be taken at the moment your order has been placed and accepted and the order confirmation been sent.We may decide not to acceptyour order in our discretion for any motivation whatsoever without liability to you. Examples of when we may not accept your order include where the products requested and ordered are out of stock or are not correctly priced or do not pass our quality control standards, or where payment has been declined. In the unlikely occasion that a product that forms your order is unavailable, it will not be replaced for an alternative item and you will not be charged for it.

CANCELLING A CONTRACT UNDER THE CONSUMER CONTRACTS REGULATION

This clause only applies to customers who live in the EU and who wish to cancel a Contract under the consumer contracts regulations 2013 (or equivalent local legislation).Your legal right to cancel a Contract starts from the date of the purchase (the date on which we email you to confirm our acceptance of your order), which is when the Contract between us is formed. You have a legal right to cancel a Contract under the consumer contracts regulations 2013 within 14 days after the day on which you receive the last item included in the dispatch confirmation. This means that during the relevant period if you change your mind or decide for any other reason that you do not want to keep an item you can contact and notify us of your decision to cancel the Contract and receive a refund. Advice about your legal right to cancel the Contract is available from your local citizens’ advice bureau or trading standards office or equivalent body (if you live outside the UK).To cancel a Contract, you just need to let us know that you have decided to cancel by returning the product(s). Our website guides you through the returning procedure. To return the product(s), you should log in (or create an account if you did not, during the purchase) to your account, using the credentials utilized during the ordering process.By selecting “my returns” in your account menu’, you will be allowed to choose the order that you would like to modify. Once you click the request return button, you will be redirected to a page where you need to select the product(s) that you want to return. After making your decision and selecting the return shipping address, you need to confirm the return request by clicking on the “request return” button. Our team will process the return and will send you the address where you must send the parcel with the product(s) that you want to return. The shipments must be realized by the clients utilizing a single carton box containing all the returning products and by communicating by email the tracking number of the realized shipment. In case you will not communicate a tracking number, we cannot ensure you that the timing for the refund will respect the schedule provided below.All the communication regarding the return process must be made by replying to the email that will communicate you the address where you have to send back the product(s) that you want to return.

IF YOU CANCEL YOUR CONTRACT WE WILL:

a)         Refund you the price you paid for the goods. However, please note we are permitted by law to reduce your refund or not proceed with your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop or which is beyond what is necessary to establish the nature characteristic and functioning of the goods. The product(s) must be sent in the same box(es) you received and all the tags and leaflets contained in the box(es) or attached to the product(s) must be kept as received (check the handling and conditions of returned goods section below).

b)         Make any refund due to you without undue delay and in any event within 14 working days after the day on which we receive the item back from you.If you have returned the goods to us under this clause because they are faulty, we will refund the costs you will incur in returning the item to us. For this purpose, you must state the reason of your return at the appropriate stage of the return process by using the specific section provided in “request return”. However, please note we cannot accept liability for an item as faulty until it has been returned to us and we have had an opportunity to inspect it and confirm that it is faulty.  We are under legal duty to supply goods that are in conformity with this Contract. As a consumer, you have legal rights in relation to goods that are faulty or not as described. These legal rights are not affected by your right of return and refund in this clause or anything else in these terms. Advice about your legal rights is available from your local citizens’ advice bureau or trading standard office ore equivalent body (if you live outside UK). We will refund you on the original method of payment. If you used a gift card to pay for the goods we will refund you by way of a gift card. If you made the payment using part giftcard and part credit / debit card or paypal, the giftcard element will be refunded first. Once you receive the address for the return, then you must return the product(s) to us without undue delay and in any event not later than 14 days after the day on which you after the day on which you let us know that you wish to return the product(s). Please note that we withhold reimbursement until we have received the goods back. Unless the item is faulty or not as described, you will be responsible for the cost of returning the item to us. You should return your items via a secured and insured delivery service as ALLPLAIN cannot accept responsibility for goods not received. We recommend you keep your tracking number until your refund has been processed and communicate it to us. Where an item which you wish to return is dispatched by you14 days after the day on which you let us know that you wish to cancel the Contract,as stated above,under the consumer contracts regulations 2013 we are not able to refund you the price you paid for the goods and the delivery costs.

REFUNDS, EXCHANGES, HANDLING AND CONDITIONS OF RETURNED GOODS

Refunds:

If you want to return an item for a refund you can do so by returning the item to our distribution centre indicated by us case by case by email within 14 days from the day that you notified us of your decision to return the product(s). The cost of the return will be borne by customers. Where an item which you wish to return is returned to us after this 14 day-period, it will not be refunded and will not be returned to you. Any refund will be executed in any event within 14 working days after the day on which we receive the item back from you. The refund itself and its value will depend on the status of the returned product(s), as defined by our quality control at reception of the returned product(s). We will refund you on the original method of payment. If you used a gift card to pay for the goods we will refund you by way of a gift card. If you made the payment using part giftcard and part credit / debit card or paypal, the giftcard element will be refunded first.

Exchanges:

In case you are not sure about your size, we recommend to order the two sizes of the product(s), which will most certainly satisfy your needs. Buying two product(s), your shipment will be free. You will be responsible for returning the goods that will not suit you at your own costs, and once we will receive them, we will refund you the costs of the product(s) you returned following the procedure described above. In case you have bought just one product and you want to exchange this item for a different size or colour, you can do so by returning the item to our distribution centre following the procedure described above. When you return the item, you must leave us a comment which says “Exchange with” and the product, size and colour that you want to receive. Additionally, if you wish to change your product for another of our product(s) we are happy to provide you this service. Follow the same procedure described above, stating the name, size and colour of the new product.We will send you the new products without charging you the shipment and refunding you the cost of the return, provided that the product returned complies with the quality described in the following section (handling and conditions of returned goods). Please be aware that this process works just when you exchange the product(s) for the reasons stated above.

Handling and conditions of returned goods:

Please take reasonable care when opening original packaging and ensure it is returned along with the goods. All goods should be inspected and tried on with reasonable care being exercised. Items should be returned unused and in a resalable condition, with all garment tags and care labels still attached. The product(s) must be sent in the same box(es) you received and all the tags and leaflets contained in the box(es) or attached to the product(s) must be kept as received.If returned items are damaged or soiled we may not accept them and may send them back to you and / or refuse a refund. Where protective casings, protective boxes, dust bags and leather tags are provided with the goods, these must be returned along with the goods. For example, all footwear must be returned in it is original shoe box, etc.

DELIVERY AND RETURNS

International Standard delivery Shipping

We offer free International Shipping to all the countries on all orders of two or more products, for order under these prices delivery is Euro 7. An internationalshipment company carries our international deliveries, and you will receive a tracking number once your order leaves our distribution centre. For shipments in UK and EU, our prices includes the applicable VAT. For all the international orders, the prices are exclusive of all taxes and duties, including UK VAT.These charges are responsibility of our customers and have to be paid on delivery of your order. Please contact your local customs office for more information. Deliveries arrive within 7 working days. However we are not responsible for any delays caused by us. Working days do not include weekends or public holidays. Outlying areas may take longer. ATTENTION PLEASE, Last posting date for Christmas is 9th December 2016. For purchases made after this date, there is no guarantee that you will get it in time for Christmas. Therefore please allow at least 15 working days for delivery if you want to receive your item(s) by Christmas.

SIGNING FOR YOUR ORDER

All orders are security sealed before leaving our distribution centre and under no circumstances should packages be signed for if these seals are broken or the packaging is damaged upon arrival. In the event that the seals are broken or the packaging is damaged, please immediately contact our customer service

GIFT CARD

ALLPLAIN issue gift cards in GBP, Euros and US dollars. Gift card values cannot be transferred into different currencies and purchases. Gift cards are non-refundable, non-exchangeable and not redeemable for cash unless otherwise required by applicable law. Unless contrary to applicable law, gift cards are valid for 24 calendar months from the date of purchase. Gift cards presented after their expiry date will be treated as void and are non-refundable and non-exchangeable. ALLPLAIN reserves the right to refuse to accept a gift card which they deem to have been tampered with, duplicated, damaged, resold or which is otherwise suspected to be fraudulently reproduced. Gift cards cannot be bought with another gift card.

PRICE OF PRODUCTS AND DELIVERY COSTS

The prices of the goods will be as quoted on our site at the time you submit your order. We take all reasonable care to ensure that the prices of goods are correct at the time when the relevant information was entered onto the system. For orders placed within the EU, all prices shown include the applicable VAT. The price of an item does not include delivery charges. Our delivery charges are as advised to you during the check-out process, before you confirm your order. It is always possible that, despite our best efforts some of the items on our site may be incorrectly priced. We will normally check prices as part of our shipment procedures so that: i) where the item’s correct price is less than the price stated on our site, and you have already paid the product(s), we will give you a discount on your next order on our website. However, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the item to you at the incorrect (lower) price; and ii) if the item’s correct price is higher than the price stated on our site, we will contact you as soon as possible to inform you of this error and we will give you the option of continuing to purchase the item at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.

PAYMENTS

You can only pay for items on our site using any one of the following methods: debit card, credit card, PayPal, giftcard or any other methods which may be clearly indicated on our site from time to time. When you use a card you confirm that the card being used is yours or that you have been specifically authorised by the owner of the card to use it. All card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay of non-delivery. If you are a customer whose card is not denominated in Euros, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction. If you choose to pay byPayPal, you will be directed to the PayPal site to ‘Log In’ and review the amount to be paid before completing your purchase. Once this transaction is complete, you will the return to our site. Payment for the goods and all applicable delivery charges is in advance. We will charge your preferred payment method at the moment your order is confirmed.

LIALIBILITY

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss of damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the Contract. We only supply the products for private use. You agree not to use the product for any commercial, business or re-sale purposes, and we have no liability to our customers for any loss of profit, loss of business, business interruption, or loss of business opportunity.

EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an event outside our control. An event outside our control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war or threat or preparation for war, fire explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, adverse weather conditions, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.  If an event outside our control takes place that affects the performance of our obligations under a Contract: i) we will contact you as soon as reasonably possible to notify you; and ii) our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the event outside our control. Where the event outside our control affects our delivery of goods to you, we will arrange a new delivery date with you after the event outside our control is over. You may cancel a Contract affected by an event outside our control which has continued for more than 30 days. To cancel please contact us. If you opt to cancel, you will have to return (at your cost) any relevant goods you have already received and we will refund the price you have paid, including any delivery charges.

OTHER TERMS

We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms. This Contract is between you and us. No other person shall have any rights to enforce any of its Terms, whether under the Contracts or otherwise. Each paragraph of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect. If we fail to insist that our perform any of your obligations under these terms, or if we do not enforce our tights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you. These terms and any dispute or claim arising out of or in connection with such matters, their subject matter or formation (including but not limited to non-contractual disputes or claims) shall be governed by, construed and interpreted in accordance with the laws of England and Wales and you agree to submit to the non-exclusive jurisdiction of the English courts. Where these terms are translated into languages other than English in the event of any conflict or inconsistency the English language terms shall prevail. We reserve the right to bring proceeding in: 1) the courts of the country of your residence; 2) the courts of the location of your access or use of the site; 3) the courts of the location of any breach by you of these terms; and / or 4) the courts of the location of your authorisation of any of the above acts.  You acknowledge and agree that damages alone would not be an adequate remedy for any breach of the terms. Accordingly, we shall be entitled to the remedies of injunction, specific performance or other equitable relief for any threatened or actual breach of the terms of these terms.
